The Firm focuses its commercial litigation practice in several areas where it has a unique set of experience and expertise.

General Commercial Litigation and Arbitration

The Firm specializes in commercial litigation in all State, Federal and Bankruptcy courts and has practiced and tried cases in all of these venues. The Firm also handles and is experienced in matters that require arbitration, where the rules and strategies can be very different than in a formal courtroom setting.

Business Disputes, including pre-litigation advice and strategy

The Firm handles business disputes, both in non-courtroom settings and after they turn into actual litigation. When a dispute arises, there are usually many opportunities for clients to help or hurt themselves in a future lawsuit. Without good advice, clients can make mistakes that will prove fatal in litigation or result in accepting a less favorable pre-litigation resolution. The Firm counsels and advises clients when possible trouble first arises and can take the necessary steps to resolve disputes before they reach the courthouse or properly position the client for success in any litigation that arises from the dispute.

Securities Litigation

The Firm specializes in securities, corporate governance and other complex business litigation, including the defense of securities class actions, derivative suits, M&A-related class actions and government investigations in which it represents individuals, board of directors and corporations. Mr. Tencer was panel counsel for AIG and its successor, Chartis, for many years while at Cooley. In addition, the firm regularly conducts internal investigations for boards as well as their audit and special litigation committees. The firm also counsels officers, directors, principal shareholders and public companies about a wide range of issues relating to corporate governance, antitrust/unfair competition, SEC enforcement, insider trading, disclosure obligations and compliance with federal and state securities laws.

Intellectual Property Litigation

The Firm specializes in all varieties of intellectual property litigation in lead counsel roles and in the role of local counsel in the Southern and Central Districts of California. It has experience dealing with a wide range of technologies, including telecommunications, software, Internet technology, cell phone technology, and biotechnology. The Firm has litigated trade secret, trademark, copyright and patent cases federal courts across the country.

Bankruptcy Litigation

The Firm has gained experience litigating adversary proceedings and contested matters in some of the most prominent bankruptcy cases in the United States. The Firm’s bankruptcy litigation practice is focused on representing individuals and entities in claims brought by bankruptcy trustees.
